Privacy Policy
This Privacy Policy governs the collection, use, storage, disclosure, and protection of personal information — including photographs, videos, CCTV footage, health declarations, and contact details — relating exclusively to the SKM Yoga Studio at F-18, Sector 39, Noida. Click on any heading below to read the complete clause. By enrolling, making payment, or entering the premises of the Noida Studio, the Member accepts and agrees to be bound by every clause of this Policy.

Important Notice: This Policy applies solely and exclusively to the SKM Yoga Noida Studio at F-18, Sector 39, Noida, and shall not govern any other SKM Yoga branch in India or abroad (including Dubai and Vietnam). The Studio premises are under CCTV surveillance, and photographs and videos captured during classes and events may be used publicly for promotional purposes as detailed in this Policy. In the event of any conflict between verbal assurances and this written Policy, the written Policy shall prevail.
Part A General Framework
1. Scope, Applicability & Binding Nature of this Policy+
This Policy constitutes a legally binding framework between SKM Yoga Studio, F-18, Sector 39, Noida (hereinafter the "Studio") and every individual who enrolls in, avails, or attends any service, class, trial, workshop, course, or event at the said premises, or whose personal information otherwise comes into the possession of the Studio, including visitors, guardians, and prospective members (hereinafter collectively the "Member"). The Policy applies solely and exclusively to the Noida Studio and shall not be construed to extend to any other branch of SKM Yoga within India or overseas, each such branch being governed by its own independent policy. Acceptance of this Policy is deemed complete upon the earliest of: submission of the enrollment or trial form, payment of any fee, or physical entry into the Studio premises, which premises are conspicuously notified as being under CCTV surveillance. This Policy has been framed with reference to the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, and the rules framed thereunder. No employee, instructor, or agent of the Studio possesses authority to make any privacy commitment beyond the express terms hereof, and only written approvals signed by the authorized Management shall bind the Studio. This Policy shall be read harmoniously with the Studio's Membership Terms and Code of Conduct, provided that in all matters concerning personal information, this Policy shall prevail.
2. Categories of Personal Information Collected by the Studio+
In the course of providing its services, the Studio collects and processes the following categories of personal information: (a) identity and contact information, including full name, age, gender, residential address, mobile number, WhatsApp number, and email address, as furnished in the enrollment, trial, or event registration forms; (b) health and fitness information voluntarily disclosed in the Health Declaration Form, including medical conditions, injuries, pregnancy status, and physician recommendations, collected solely to ensure safe practice; (c) payment information, limited to transaction references, receipt numbers, and payment mode, it being clarified that the Studio does not itself store complete card numbers, CVV, PIN, or banking passwords; (d) visual information, comprising photographs and video recordings captured during classes, workshops, aerial sessions, photoshoots, and events, together with CCTV footage of the premises; (e) attendance and batch records, membership history, freeze and transfer records; and (f) emergency contact details of a person nominated by the Member. The Member warrants that all information furnished is true, complete, and current, and undertakes to promptly notify the Studio of any material change, particularly in health information upon which the Studio's safety protocols are premised.
3. Purposes for Which Information Is Collected & Used+
The Studio collects and uses personal information strictly for lawful purposes connected with its services, namely: (a) enrollment, batch allocation, attendance tracking, and membership administration; (b) design and adaptation of safe yoga practice, including screening for contraindications in aerial, therapy, prenatal, and senior programs on the basis of the Health Declaration Form; (c) processing of payments, issuance of receipts, and maintenance of accounts as required under taxation and other applicable laws; (d) communication of class schedules, batch changes, closures, offers, renewals, events, and service-related notices through call, SMS, WhatsApp, and email; (e) safety, security, and incident investigation through CCTV surveillance of the premises; (f) promotion and marketing of the Studio through photographs, videos, testimonials, and transformation stories, in the manner and subject to the conditions set out in Part B of this Policy; and (g) compliance with legal obligations, court orders, and lawful requests of governmental authorities. The Studio shall not use personal information for purposes materially incompatible with those stated herein without obtaining fresh consent, and shall at all times endeavour to collect only such information as is reasonably necessary for the stated purposes.
4. Consent — Grant, Scope & Right of Withdrawal+
By signing the enrollment form, making payment, or entering the premises after due notice of this Policy, the Member grants free, informed, specific, and unambiguous consent to the collection and processing of personal information for the purposes stated herein. Consent for promotional use of photographs and videos under Part B is obtained through the media consent declaration forming part of the enrollment documentation, and the Member may decline or limit such promotional consent at the time of enrollment without any effect on access to classes. A Member may withdraw any previously granted consent, wholly or partly, at any time by submitting a written request at the Studio front desk or via WhatsApp to 8920921620; withdrawal shall operate prospectively and shall not affect the lawfulness of processing already undertaken, nor shall it obligate the Studio to recall, delete, or take down materials already published, printed, or distributed prior to the date of withdrawal, save as provided in Clause 8. Where withdrawal of consent renders the provision of a particular service impossible — for example, refusal of the Health Declaration Form in therapy programs — the Studio may decline that particular service while continuing other services unaffected. Consent given on behalf of a minor shall be governed by Clause 14.
5. CCTV Surveillance of the Studio Premises+
The Member is hereby informed, and acknowledges, that the Studio premises — including both practice halls, the reception and office area, entrances, exits, and common passages — are under continuous CCTV surveillance, operational twenty-four hours a day, for the purposes of safety of members and staff, security of property and equipment, prevention and investigation of theft, misconduct, or safety incidents, and monitoring of adherence to safety protocols during aerial and other practice. CCTV cameras are not installed in bathrooms, washrooms, or changing areas, and the Studio maintains a strict prohibition on any recording device in such areas. CCTV footage is stored on secured systems with access restricted to authorized Management personnel only, and is retained for a rolling period of approximately thirty (30) to ninety (90) days, whereafter it is automatically overwritten, save where specific footage is preserved for an ongoing investigation, insurance claim, or legal proceeding. CCTV footage shall not be used for promotional or marketing purposes and shall be disclosed only to law enforcement or judicial authorities upon lawful demand, to insurers in connection with a claim, or as otherwise required by law. Requests by a Member to view footage concerning an incident involving that Member shall be considered by Management on written request, subject to protection of the privacy of other individuals appearing in such footage.
6. Storage, Security & Confidentiality of Information+
The Studio implements reasonable security practices and procedures, commensurate with the nature of the information held, to protect personal information against unauthorized access, alteration, disclosure, or destruction. Physical enrollment forms and health declarations are stored in secured cabinets within the Studio office with access restricted to authorized personnel; digital records are maintained on password-protected systems; and CCTV storage is secured as described in Clause 5. Health information disclosed in the Health Declaration Form is treated as confidential and is shared internally only with the instructors and therapists directly responsible for the Member's practice, strictly on a need-to-know basis for safety of instruction. Staff and instructors are bound by confidentiality obligations under their engagement terms, and breach thereof attracts disciplinary action. The Member acknowledges, however, that no method of storage or transmission is completely secure, and that the Studio's obligation is one of reasonable safeguards and not an absolute guarantee against every conceivable breach. The Member is advised not to share sensitive information over unverified channels and to communicate only through the Studio's official numbers, 8920921620 and 8826476724, and the official website skmyoga.in. Payment card data is handled exclusively by the respective bank, card network, or UPI platform at the time of transaction.
Part B Photography, Videography & Public Use
7. Photography & Videography by the Studio During Classes & Events+
The Member acknowledges that the Studio, in the ordinary course of its activities, captures photographs and video recordings during regular classes, aerial yoga sessions, workshops, teacher training programs, sound healing sessions, International Yoga Day celebrations, community camps, and other events conducted at or by the Noida Studio. Such capture is undertaken by authorized Studio personnel or engaged photographers under the Studio's direction, and reasonable notice of active shooting shall be given at the commencement of a class or event wherever practicable. A Member who does not wish to appear in such media may inform the instructor or front desk at any time, whereupon reasonable efforts shall be made to exclude that Member from the frame, position the Member outside the shooting zone, or edit out identifiable appearances prior to publication. Candid and group captures being inherent to a live class environment, the Member accepts that incidental background appearance may occur despite such efforts, and agrees that such incidental appearance, where the Member is not the focus of the frame, shall not constitute a violation of this Policy. Media captured by the Studio shall remain the property of the Studio, subject always to the use limitations and the opt-out and takedown rights set out in Clauses 8 and 16.
8. Public & Promotional Use of Photographs and Videos+
Subject to the media consent obtained under Clause 4, the Member grants the Studio a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, publish, and publicly display photographs and video recordings in which the Member appears, for the promotion of the Studio and of yoga generally, across the following channels: the Studio's website skmyoga.in; the Studio's official social media handles on YouTube, Instagram, and Facebook (@skmyoga); printed brochures, standees, hoardings, and display boards at the premises; press releases and media features; and event recap videos and reels. The Member acknowledges that such use is made without payment of any fee, royalty, or compensation, the consideration being the mutual promotion of the yoga community, and that published material may remain publicly accessible indefinitely. The Studio undertakes that promotional media shall be dignified and respectful, shall never be used in a defamatory, obscene, or misleading manner, and shall not disclose the Member's contact details, health information, or full residential address. A Member may at any time request removal of a specific published item in which the Member is identifiable, by written request under Clause 16, and the Studio shall take down such item from channels within its direct control within thirty (30) days, it being clarified that the Studio cannot recall copies already downloaded, shared, or republished by third parties.
9. Photography by Members & Visitors — Rules Inside the Studio+
In order to protect the privacy of all practitioners, photography and videography by Members and visitors within the practice halls is regulated as follows. A Member may photograph or record only himself or herself — for example, personal progress photos or aerial poses — and only with the prior permission of the instructor conducting the class, at such time and place as does not disturb the class. Photographing or recording any other member, staff member, or child without that person's express consent is strictly prohibited, and constitutes a material breach of the Studio's Code of Conduct attracting suspension or termination of membership without refund. Photography and recording of any nature is absolutely prohibited in bathrooms, washrooms, and changing areas, and any violation shall be treated as gross misconduct warranting immediate termination and, where appropriate, report to law enforcement. Live-streaming of classes by Members is not permitted without the prior written approval of Management. Where a Member publishes self-captured content on personal social media, the Member does so in his or her personal capacity; the Studio appreciates voluntary tagging of @skmyoga but assumes no responsibility for content published by Members on their own accounts, including the appearance of other individuals therein, responsibility for which rests solely with the publishing Member.
10. Aerial Photoshoots, Event Coverage & Third-Party Photographers+
The Studio periodically organizes dedicated aerial photoshoot sessions, event photography, and videography days, participation in which is entirely voluntary. By registering for such a session, the participating Member expressly consents to being photographed and recorded, and to the use of the resulting media in accordance with Clause 8, unless the Member specifies in writing at registration that the media is for personal delivery only. Where the Studio engages third-party photographers or videographers for such sessions or for events, such engagement shall be under terms obligating the photographer to hand over the captured media to the Studio, to refrain from independent publication of identifiable member imagery without the Studio's approval, and to delete raw footage upon completion of the engagement, save for portfolio use with the concerned Member's direct consent. Media captured during large public events — including International Yoga Day gatherings, society camps, park sessions, and community workshops conducted in open or public venues — is treated as event coverage of a public gathering, and by participating in such public events the attendee consents to appearing in general event coverage; requests for removal of specifically identifiable images from Studio-controlled channels shall nonetheless be honoured under Clause 16. Press and media personnel covering Studio events operate under their own editorial responsibility, and the Studio shall facilitate but cannot guarantee removal requests directed at independent press publications.
11. Testimonials, Transformation Stories & Use of Member Names+
The Studio may, with the specific consent of the concerned Member, publish testimonials, reviews, interviews, and transformation stories — including before-and-after photographs, weight or flexibility milestones, and recovery narratives — on the channels described in Clause 8. Given that transformation stories may touch upon health conditions, therapy outcomes, or personal journeys, the Studio shall obtain separate, specific written consent for each such story prior to publication, and shall publish only such details as the Member approves, using the Member's first name only or a chosen display name where the Member so prefers. Reviews voluntarily posted by Members on public platforms such as Google, Facebook, or Instagram are governed by the terms of those platforms, and the Studio may reproduce or quote such publicly posted reviews in its promotional material with attribution. The Member may withdraw consent to a published testimonial or transformation story at any time under Clause 16, whereupon the Studio shall remove it from channels within its control within thirty (30) days. The Studio shall never publish, in connection with any testimonial, the Member's contact number, address, or medical documentation, and shall never sell testimonial content or member stories to any third party for consideration.
Part C Data Sharing, Minors & Member Rights
12. Disclosure & Sharing of Information with Third Parties+
The Studio does not sell, rent, or trade personal information of Members to any third party for monetary consideration, and shall never do so. Personal information may be disclosed only in the following limited circumstances: (a) to banks, card networks, and UPI platforms, to the extent inherent in processing a payment initiated by the Member; (b) to another SKM Yoga branch, limited to name, contact details, membership balance, and program history, where the Member requests a branch transfer under the Studio's transfer provisions; (c) to instructors and therapists of the Studio, on a need-to-know basis, for safe conduct of the Member's practice; (d) to the Member's nominated emergency contact and to medical responders, in the event of a medical emergency at the premises; (e) to insurers, legal advisors, and auditors of the Studio, under obligations of confidentiality, in connection with claims, compliance, or professional advice; and (f) to police, courts, and governmental authorities, pursuant to a lawful order, notice, or legal obligation. Any service provider engaged by the Studio for communications, website management, or data storage shall be bound contractually to process information only on the Studio's instructions and to maintain confidentiality and security standards no less protective than this Policy.
13. Communications — Calls, SMS, WhatsApp & Email+
By furnishing a mobile number and email address, the Member consents to receive service communications from the Studio — including batch confirmations, schedule changes, closure notices, renewal reminders, fee receipts, and safety advisories — through calls, SMS, WhatsApp messages from the Studio's official numbers 8920921620 and 8826476724, and email. The Member further consents to receive promotional communications regarding new programs, workshops, events, and offers of the Noida Studio, provided that the Member may opt out of promotional communications at any time by communicating "STOP" or an equivalent instruction on WhatsApp, informing the front desk in writing, or using any unsubscribe mechanism provided; service communications essential to the membership shall continue notwithstanding a promotional opt-out. The Studio shall not use the Member's number to add the Member to any broadcast group or community group without an opportunity to exit, and shall not share the Member's number with other members without consent. The Member is cautioned that the Studio never solicits OTPs, passwords, card numbers, or remote-access installations over any communication channel, and any such request purporting to be from the Studio should be treated as fraudulent and reported immediately to 8826476724.
14. Minors — Kids Yoga, Parental Consent & Special Protections+
Enrollment of any individual below eighteen (18) years of age — including participants of kids yoga batches aged four (4) to sixteen (16) — shall be made only by a parent or legal guardian, who shall furnish the child's information, sign the Health Declaration Form, and grant or decline all consents under this Policy on the child's behalf. Photographs and videos in which a minor is identifiable shall be used for promotional purposes under Clause 8 only where the parent or guardian has granted specific written media consent for the minor, which consent may be declined or withdrawn at any time without affecting the child's access to classes; where such consent is declined, the Studio shall exclude the child from promotional frames or blur the child's identifiable features prior to publication. The Studio shall never publish a minor's full name, school, address, or contact information in any promotional material. Communications concerning a minor shall be addressed exclusively to the parent or guardian's registered contact details. CCTV coverage of kids batches operates identically to Clause 5, with footage access further restricted in matters concerning minors. Any concern regarding a minor's privacy or safety shall be escalated on priority to Management at 8826476724 and shall be handled with the highest sensitivity.
15. Health Information — Heightened Confidentiality Standard+
Health and medical information furnished by the Member — including conditions disclosed in the Health Declaration Form, therapy intake discussions, injury reports, pregnancy status, and physician certificates submitted for freezes or program modifications — is accorded a heightened standard of confidentiality under this Policy. Such information shall be used exclusively for: designing safe and appropriate practice for the Member; screening contraindications for aerial, inversion, therapy, prenatal, senior, and cardiac-safe programs; responding to medical situations at the premises; and processing freeze or modification requests founded on medical grounds. Access is restricted to Management and to the specific instructors and therapists responsible for the Member's practice, each bound by confidentiality obligations. Health information shall never be used for marketing, shall never appear in any testimonial or transformation story without the separate specific consent described in Clause 11, and shall never be disclosed to other members, to employers, or to any third party save under Clause 12(d), (e), or (f). Physical health documents are stored securely and destroyed confidentially upon expiry of the retention period in Clause 17. The Member acknowledges that accurate and complete health disclosure is a safety prerequisite, and that this confidentiality standard exists precisely so that Members may disclose freely and practice safely.
16. Member Rights — Access, Correction, Deletion & Takedown+
Every Member enjoys the following rights in respect of personal information held by the Studio, exercisable by written request at the front desk or via WhatsApp to 8920921620: (a) the right of access — to obtain a summary of the categories of personal information the Studio holds concerning the Member; (b) the right of correction — to have inaccurate or outdated information (including contact details and health updates) corrected promptly; (c) the right of erasure — to request deletion of personal information that is no longer necessary for the purposes of this Policy, subject to retention obligations under Clause 17 and under taxation, accounting, and other applicable laws; (d) the right of takedown — to require removal of identifiable photographs, videos, testimonials, or stories from channels within the Studio's control, which the Studio shall effect within thirty (30) days of a verified request; (e) the right to withdraw consent prospectively under Clause 4; and (f) the right of grievance — to escalate any privacy concern to Management at 8826476724 and to receive a substantive response within fifteen (15) working days. The Studio may verify the identity of the requester before acting on any request, and may decline requests that are manifestly unfounded, repetitive, or that would infringe the rights of another individual, recording reasons for any such refusal.
Part D Retention, Online Services & Legal Provisions
17. Retention & Destruction of Personal Information+
Personal information shall be retained only for so long as is necessary for the purposes stated in this Policy or as required by law, in accordance with the following indicative schedule: enrollment records, attendance, and membership history — for the duration of the membership and for a period of up to three (3) years thereafter, for re-enrollment convenience, dispute resolution, and record-keeping; payment records and receipts — for the period mandated under taxation and accounting laws, presently up to eight (8) years; Health Declaration Forms and medical certificates — for the duration of the membership and one (1) year thereafter, whereafter they are confidentially destroyed; CCTV footage — on a rolling basis of approximately thirty (30) to ninety (90) days as stated in Clause 5, save preserved incident footage; and promotional photographs and videos — indefinitely while they continue to serve a promotional purpose, subject always to the takedown right in Clause 16. Upon expiry of the applicable retention period, physical records are shredded and digital records are deleted or irreversibly anonymized. Anonymized and aggregated information — such as batch occupancy statistics or program popularity data from which no individual can be identified — may be retained and used by the Studio indefinitely for planning and improvement of services.
18. Website, Online Classes & Digital Interactions+
The Studio's website skmyoga.in may use cookies and similar technologies for essential site functionality, remembering preferences, and understanding aggregate visitor behaviour through analytics; the Member may control cookies through browser settings, subject to possible loss of certain site conveniences. Enquiry and booking forms on the website collect only the information fielded therein, which is processed in accordance with this Policy. In respect of live online classes offered by the Studio, the Member acknowledges that classes are conducted over third-party video platforms whose own terms and privacy policies additionally apply; that the Member's display name and camera feed are visible to the instructor and, in group classes, to co-participants; and that a Member may practice with camera off where personal correction is not required. Online classes are not recorded by the Studio save where a recording is expressly announced at the commencement of a session for training or quality purposes, and recording of online classes by Members is prohibited without the Studio's prior written approval. Links on the Studio's website or social media to third-party pages are provided for convenience, and the Studio is not responsible for the privacy practices of such third parties. The Studio's official digital presence is limited to skmyoga.in and the @skmyoga handles; the Studio bears no responsibility for impersonating pages, and Members are urged to report suspected impersonation to 8826476724.
19. Data Incidents, Breach Response & Grievance Redressal+
In the event the Studio becomes aware of a data incident — meaning unauthorized access to, disclosure of, or loss of personal information likely to cause harm to affected Members — the Studio shall act promptly to contain the incident, assess its scope and severity, and remediate the vulnerability. Where the incident is assessed as likely to result in significant harm to identifiable Members, the Studio shall inform the affected Members through their registered contact details without undue delay, describing the nature of the incident and the protective steps the Member may take, and shall make such reports to authorities as applicable law requires. All privacy-related grievances, questions, and requests shall be addressed to the Studio's designated Grievance Officer, reachable through the front desk at F-18, Sector 39, Noida, or at the escalation number 8826476724, or through skmyoga.in; the Grievance Officer shall acknowledge every written grievance within seventy-two (72) hours and endeavour to resolve it within fifteen (15) working days of receipt. The Member agrees to first exhaust this grievance mechanism before initiating any external proceeding, save where urgent judicial relief is necessary. Nothing in this clause limits any right of the Member under applicable data protection law, and the Studio shall cooperate in good faith with any lawful inquiry of the competent data protection authority.
20. Governing Law, Jurisdiction, Severability & Amendments+
This Policy shall be governed by and construed in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023, and the Information Technology Act, 2000, as amended from time to time. All disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts and fora at Gautam Buddha Nagar, Uttar Pradesh. Prior to initiating any legal proceeding, the parties shall attempt good-faith resolution through the grievance mechanism described in Clause 19 for a period of fifteen (15) days from written intimation of the grievance. Nothing herein shall exclude, restrict, or override any non-waivable right available to the Member under applicable data protection or consumer law. If any clause of this Policy is held invalid or unenforceable by a competent authority, the remaining clauses shall continue in full force, the offending clause being read down to the minimum extent necessary. The Studio may amend this Policy prospectively by displaying the amended version at the premises and on skmyoga.in, and continued use of the Studio's services after such display shall constitute acceptance of the amended Policy; provided that any amendment materially expanding the promotional use of member imagery shall apply only to media captured after the amendment or upon fresh consent. This Policy constitutes the entire understanding between the Member and the Noida Studio on the subject of privacy and personal information, superseding all prior representations and verbal assurances.
