Terms & Conditions

These Terms & Conditions constitute the binding agreement governing all classes, memberships, programs, courses, and services offered at the SKM Yoga Studio, F-18, Sector 39, Noida. Click on any heading below to read the complete term. By enrolling, making payment, or attending any class at the Noida Studio, the Member accepts and agrees to be bound by each of the fifty terms set out herein.

Important Notice: These Terms apply solely and exclusively to the SKM Yoga Noida Studio at F-18, Sector 39, Noida, and shall not govern any other SKM Yoga branch in India or abroad (including Dubai and Vietnam). These Terms operate together with the Studio's Refund & Cancellation Policy and Privacy Policy, which stand incorporated herein by reference. In the event of any conflict between verbal assurances and these written Terms, the written Terms shall prevail.
Part A Agreement & Enrollment
1. Formation of Agreement & Deemed Acceptance+
These Terms constitute a legally binding agreement between SKM Yoga Studio, F-18, Sector 39, Noida (hereinafter the "Studio") and every individual who enrolls in, purchases, or attends any class, membership, program, workshop, or course at the said premises (hereinafter the "Member"). Acceptance of these Terms is deemed complete, without the necessity of a signature, upon the earliest occurrence of any of the following: submission of the enrollment or trial registration form; payment of any fee, whether in full or in part; or physical attendance of any class or session. The Member acknowledges having been afforded a reasonable opportunity to read and understand these Terms prior to enrollment, and that continued attendance constitutes continuing affirmation of acceptance. Where a Member enrolls on behalf of another individual, the enrolling person warrants that they possess due authority to bind such individual, and both shall be jointly bound hereby.
2. Eligibility, Enrollment Formalities & Accuracy of Particulars+
Enrollment at the Studio is open to individuals of all ages, subject to allocation into age-appropriate batches and, in the case of persons below eighteen (18) years, enrollment by a parent or legal guardian in accordance with these Terms. Every prospective Member shall complete the prescribed enrollment form and Health Declaration Form, furnishing particulars that are true, accurate, complete, and current in all respects. The Studio reserves the unfettered right to decline any application for enrollment without assigning reasons, including where batch capacity stands exhausted or where the Studio reasonably apprehends that safe participation cannot be assured. Any misrepresentation, suppression, or falsification of material particulars — including age, identity, or health status — shall entitle the Studio to terminate the membership forthwith without refund, without prejudice to such further remedies as may be available to the Studio in law. The Member undertakes to promptly notify the Studio of any material change in the particulars furnished.
3. Health Declaration — A Condition Precedent to Participation+
Completion of the Studio's Health Declaration Form, with full and candid disclosure of all material health conditions — including without limitation cardiac conditions, hypertension, vertigo, glaucoma, hernia, recent surgeries, musculoskeletal injuries, pregnancy, and any condition affecting balance or exertion tolerance — constitutes a condition precedent to participation in any class or program. The Member acknowledges that every safety protocol of the Studio, including screening for contraindications in aerial, inversion, therapy, prenatal, and senior programs, is premised entirely upon the accuracy of such disclosure. The Studio and its instructors are entitled to rely conclusively upon the declarations furnished, and shall bear no liability whatsoever for any injury, aggravation, or adverse outcome attributable to a condition that was suppressed, misdeclared, or not updated. Where a material change in health occurs during the subsistence of the membership, the Member shall update the declaration before attending any further class, failing which continued participation shall be at the Member's sole risk.
4. Nature of Membership — Personal Licence, Not a Transferable Right+
A membership of the Studio constitutes a personal, revocable, and non-transferable licence to attend the classes and avail the facilities corresponding to the package purchased, during its stated validity, and confers no proprietary, tenancy, or other interest in the Studio premises or its equipment. The membership is issued to the named Member alone; attendance by any other person under a Member's enrollment, or the sharing, lending, sale, or assignment of membership access, is strictly prohibited and shall render the membership liable to immediate cancellation without refund. Transfer of membership is permissible solely in the limited circumstances, and upon the conditions, set out in the Studio's Refund & Cancellation Policy. The Studio may issue membership cards, digital credentials, or attendance identifiers, which remain the property of the Studio and must be surrendered upon expiry or termination. Admission to the premises may be declined where identity or membership validity cannot be reasonably verified.
5. Territorial Scope — Applicability to the Noida Studio Alone+
These Terms apply solely and exclusively to services rendered at, or organized by, the SKM Yoga Studio situated at F-18, Sector 39, Noida, Uttar Pradesh, including its two practice halls, and to home classes and online classes administered by the said Studio. They shall not be construed to extend to, or create any obligation upon, any other branch, franchise, or centre of SKM Yoga within India or overseas — including the international centres at Dubai and Vietnam — each of which operates under its own independent terms, pricing, and policies. A Member availing a branch transfer shall, from the effective date of such transfer, be governed by the terms of the receiving branch, and these Terms shall thereupon cease to apply save in respect of accrued rights and obligations. Nothing herein shall be construed as a representation that identical programs, schedules, or facilities are available at other branches of the SKM Yoga network.
6. Amendment of Terms, Schedules & Programs+
The Studio reserves the right to amend these Terms, its class schedules, program structures, batch compositions, and rules of conduct prospectively, at any time, by displaying the amended version at the Studio premises and on skmyoga.in. Continued attendance or use of the Studio's services after such display shall constitute conclusive acceptance of the amended Terms. No amendment shall retrospectively divest a Member of rights accrued in respect of fees already paid, nor shall any amendment materially diminish the core service purchased without offering the affected Member a reasonable alternative of equivalent value. Routine operational adjustments — including changes to batch timings, reallocation of instructors between the two practice halls, and substitution of class formats of comparable nature — are expressly acknowledged as ordinary incidents of studio administration and shall not constitute an amendment requiring notice, nor give rise to any claim, where a reasonable alternative batch remains available to the Member.
7. Official Communications & Notices+
All official communications of the Studio — including schedule changes, closure notices, renewal reminders, safety advisories, and policy updates — shall be made through one or more of the following channels: display at the Studio notice board; the official website skmyoga.in; the official numbers 8920921620 (calling) and 8826476724 (WhatsApp); the official email admin@skmyoga.in; and the official social media handles @skmyoga on YouTube and Instagram and yogaskmnoida on Facebook. Communication through any such channel shall constitute sufficient and valid notice to all Members. The Member is responsible for keeping their registered mobile number and email address current, and the Studio shall not be liable for non-receipt of communications attributable to outdated particulars, blocked numbers, or spam filtering. The Member is cautioned that the Studio never solicits OTPs, passwords, or card credentials through any channel, and any such solicitation purporting to emanate from the Studio should be disregarded and reported immediately to 8826476724.
8. Records, Attendance & Administrative Authority+
The Studio shall maintain records of enrollment, attendance, batch allocation, payments, freezes, and transfers, and such records, maintained in the ordinary course of business, shall constitute presumptive evidence of the matters recorded therein in the event of any dispute. Attendance shall be marked in the manner prescribed by the Studio from time to time, and the Member shall cooperate with such attendance procedures. The authorized Management of the Studio shall have final administrative authority over batch allocation, hall assignment as between the two practice halls, instructor deployment, capacity management, and all operational matters, exercised reasonably and in the interest of the membership as a whole. Front-desk personnel and instructors act within delegated authority only; no assurance, concession, or exception communicated by any staff member shall bind the Studio unless confirmed in writing under the signature of authorized Management, and Members are advised to obtain written confirmation of any arrangement deviating from these Terms.
Part B Fees, Packages & Financial Terms
9. Payment of Fees & Modes of Payment+
All fees for memberships, personal sessions, home classes, courses, and workshops shall be paid in advance, in Indian Rupees, through the modes accepted by the Studio — namely UPI, debit card, credit card, and cash — against a valid receipt issued for every payment. Access to classes is conditional upon fees standing fully paid or, where an instalment arrangement has been expressly sanctioned in writing, upon instalments being paid punctually on their due dates. Default in payment of any sanctioned instalment shall entitle the Studio to suspend access until regularization, and persistent default shall entitle the Studio to terminate the membership, treating fees paid as consideration for the period of access already enjoyed. The Member shall preserve all payment receipts for the duration of the membership, as claims and reconciliations shall be entertained solely against valid Studio receipts. Payments made to any individual otherwise than against an official receipt are made at the Member's own risk.
10. Taxes, Levies & Statutory Charges+
All fees quoted by the Studio are, unless expressly stated otherwise, inclusive or exclusive of Goods and Services Tax and other applicable statutory levies as indicated on the prevailing rate card, and the Member shall bear all taxes, cesses, and governmental charges applicable to the services availed, at the rates in force from time to time. Where any change in law imposes a new levy, or enhances an existing levy, upon the services during the subsistence of a membership, the Studio shall be entitled to collect such incremental amount for the unexpired period, and shall correspondingly pass on the benefit of any reduction. Taxes once deposited with governmental authorities may be non-recoverable, and their treatment upon any refund shall be governed by the Studio's Refund & Cancellation Policy. The Studio shall issue tax-compliant invoices or receipts in accordance with applicable law, and any request for correction of invoice particulars must be made within seven (7) days of issuance.
11. Package Validity, Commencement & Expiry+
Every membership package — whether of three (3), six (6), or twelve (12) months' duration — shall commence upon the Activation Date as defined in the Studio's Refund & Cancellation Policy, being the earlier of the first attended class or the seventh calendar day following payment, and shall expire automatically upon the completion of its stated duration, computed in calendar months, subject only to extensions arising from sanctioned freezes or Studio-initiated closures. The validity of a package runs continuously irrespective of the Member's actual attendance, and unutilized classes, days, or sessions within the validity period shall lapse upon expiry without carry-forward, credit, or refund. It is the Member's responsibility to remain aware of their expiry date, which the front desk shall confirm upon request at any time. Renewal within seven (7) days of expiry shall preserve continuity benefits, where offered; renewals thereafter shall be treated as fresh enrollments at prevailing rates.
12. Pricing, Rate Revisions & Existing Members+
The Studio reserves the right to revise its rate card, package pricing, and charges for personal sessions, home classes, courses, and workshops prospectively at any time, without prior notice, such revision taking effect from the date of display at the Studio or on skmyoga.in. A rate revision shall not affect the validity or entitlements of any membership already purchased and subsisting on the date of revision; the revised rates shall apply only to fresh enrollments, renewals, upgrades, and additional services purchased thereafter. Quotations and proposals issued by the Studio for corporate programs, society batches, or events shall remain valid for the period stated therein, and in the absence of a stated period, for fifteen (15) days from issuance. The Member acknowledges that pricing may lawfully differ across batches, programs, timings, and enrollment channels, and that no claim shall lie merely because another member enrolled at a different price under a different offer or at a different time.
13. Promotional Offers, Discounts & Referral Benefits+
Promotional offers, festival discounts, referral benefits, and complimentary inclusions announced by the Studio from time to time are discretionary concessions, subject to the specific conditions attached to each offer, and are incapable of being claimed as of right, combined with one another, exchanged for cash, or extended beyond their announced validity. The Studio reserves the right to modify, suspend, or withdraw any offer prospectively at any time. Referral benefits, where announced, accrue only upon the referred individual completing enrollment and payment, and shall be credited in the form and within the timeline specified in the offer. Any benefit obtained through misuse of an offer — including creation of duplicate identities, circular referrals, or misrepresentation of eligibility — shall stand forfeited, and the Studio may recover the value of benefits wrongly availed. Discounted and promotional enrollments remain subject to the non-refundability provisions of the Refund & Cancellation Policy applicable to such packages.
14. Freezes, Transfers & Refunds — Incorporation by Reference+
All matters concerning the freezing of memberships, transfer of memberships to family members or to other branches, issuance and utilization of studio credit, cooling-off rights, and the eligibility, computation, and processing of refunds are governed exhaustively by the Studio's Refund & Cancellation Policy, which stands incorporated into these Terms by reference as though set out herein in full. The Member confirms having had the opportunity to review the said Policy — displayed at the Studio and on skmyoga.in — prior to enrollment. In the event of any inconsistency between these Terms and the Refund & Cancellation Policy on matters of refund, freeze, or transfer, the provisions of the said Policy shall prevail. No claim for refund, freeze, or transfer shall be maintainable otherwise than in accordance with the procedure prescribed therein, including the requirement of a Written Request submitted through the channels designated by the Studio, namely the front desk or WhatsApp to 8826476724.
15. Outstanding Dues & Right of Set-Off+
The Member shall remain liable for all sums due to the Studio, including unpaid instalments, charges for additional services availed, costs of repair or replacement of equipment damaged through the Member's negligence or misuse, and any amounts wrongly received or benefits wrongly availed. The Studio shall be entitled, without prejudice to its other remedies, to set off any such outstanding dues against any refund, credit, deposit, or other amount payable to the Member under any policy of the Studio, and to withhold issuance of certificates, transfer letters, or no-dues confirmations until all outstanding amounts stand cleared. A statement of dues issued by the Studio from its records shall constitute presumptive evidence of the amounts owed. Where dues remain unpaid despite written demand, the Studio reserves the right to suspend services, terminate the membership, and pursue recovery through lawful means, with the defaulting Member bearing reasonable costs of recovery as permitted by law.
16. No Guarantee of Specific Results+
While the Studio brings seventeen years of institutional teaching experience, certified instructors, and structured program design to every batch, the Member expressly acknowledges that outcomes of yoga practice — including weight loss, flexibility gains, strength development, therapeutic relief, stress reduction, and improvement in health parameters — vary from individual to individual and depend materially upon factors within the Member's exclusive control, including regularity of attendance, adherence to instructor guidance, diet, sleep, lifestyle, and underlying constitution. Accordingly, no representation, warranty, or guarantee of any specific result, timeline, or transformation is made or shall be implied, and illustrative timelines communicated in marketing material or consultations are indicative estimates only. Dissatisfaction with the pace or extent of personal results shall not constitute deficiency of service nor found any claim for refund or damages. Testimonials and transformation stories published by the Studio reflect individual experiences and are not assurances of comparable outcomes for any other Member.
Part C Classes, Conduct & Studio Discipline
17. Batch Allocation, Capacity & Hall Assignment+
Members shall be allocated to specific batches at the time of enrollment, having regard to the Member's preference, program suitability, and available capacity across the Studio's two practice halls. Batch capacity is deliberately limited to preserve instructional quality and, in the case of aerial batches, is further constrained by the number of rigged anchor points; accordingly, attendance is permissible only in the allocated batch, and walk-in attendance in a different batch requires prior front-desk approval subject to available capacity. The Studio may, for operational reasons, reassign a batch between the two halls, merge under-subscribed batches, or introduce additional batches, provided a reasonable alternative remains available to affected Members. Batch changes requested by Members are accommodated free of charge, subject to capacity, upon intimation to the front desk. Persistent attendance in unallocated batches without approval may be treated as a breach of studio discipline attracting appropriate administrative action.
18. Punctuality, Late Entry & Class Protocol+
Members are expected to arrive at least ten (10) minutes prior to the commencement of their class, to settle in and commence practice with composure. The opening warm-up being integral to injury prevention, entry into a class more than ten (10) minutes after commencement may be declined at the instructor's discretion, particularly in dynamic, power, and aerial formats where unwarmed participation carries elevated risk; a Member so declined may await the next available batch subject to capacity. Members shall follow the instructor's sequence and pacing, shall not undertake unsupervised advanced practice out of turn, and shall conclude practice with the class rather than departing mid-session save for genuine necessity communicated to the instructor. Conversations during class shall be kept to the minimum necessary, and conduct that disrupts the practice environment of fellow members — in either practice hall — may attract a request to leave the session, without any claim arising therefrom.
19. Attire, Personal Hygiene & Practice Etiquette+
Members shall attend classes in comfortable, modest, stretchable attire appropriate to yoga practice; for aerial formats, clothing covering the backs of the knees and underarms is mandatory, and attire bearing zips, buckles, rivets, or embellishments capable of snagging hammock fabric is prohibited. Practice is conducted barefoot; footwear shall be placed in the designated area. Members shall maintain reasonable personal hygiene, keep nails trimmed for the protection of themselves, fellow members, and equipment, remove jewellery and watches during practice, and refrain from strong fragrances that may cause discomfort in an enclosed practice hall. Personal mats, where brought, must be clean; Studio mats and props shall be wiped after use with the materials provided and returned to their designated places. Eating within the practice halls is not permitted; water in spill-proof bottles is permitted. The Studio may decline participation, without any claim arising, where attire or hygiene poses a safety or comfort concern to the class.
20. Mobile Phones, Devices & Practice-Hall Discipline+
Mobile phones and electronic devices shall be kept on silent mode within the practice halls, and calls shall not be attended inside the halls during class; a Member expecting an unavoidable urgent call shall inform the instructor in advance and step out quietly to attend it. The use of devices during class for messaging, browsing, or entertainment is prohibited as being disruptive to the meditative environment that the Studio undertakes to preserve for all members. Photography and videography by Members within the premises are governed strictly by the Studio's Privacy Policy, which permits self-capture alone, with instructor permission, and absolutely prohibits the recording of other members, staff, or children without express consent, and all recording of any nature in bathrooms and changing areas. Smart devices with recording capability shall not be worn during aerial practice where they may compromise grip or safety. Violation of this term may attract suspension of access without refund for the period of suspension.
21. Code of Conduct & Mutual Respect+
The Studio is a shared space of practice, healing, and learning, and every Member undertakes to conduct themselves with courtesy, dignity, and mutual respect toward fellow members, instructors, and staff at all times. The following conduct is strictly prohibited and shall constitute material breach: harassment of any nature, whether verbal, physical, or through electronic means; discriminatory, abusive, or intimidating behaviour; unwelcome physical contact; persistent unwelcome social advances toward any member or staff; disparagement of other members' bodies, abilities, or progress; and any conduct that a reasonable person would find hostile or degrading. Complaints of misconduct shall be received in confidence by Management at 8826476724 and inquired into fairly, and the Studio may, pending inquiry, suspend the access of the person complained against. Substantiated misconduct shall attract termination of membership without refund, and, where the conduct discloses an offence, report to the appropriate authorities. The Studio's commitment to a safe environment extends equally to both practice halls and all programs.
22. Authority of Instructors & Compliance with Directions+
Instructors of the Studio — certified professionals trained under the SKM Yoga methodology and mentored by Dr. Shivam Mishra — exercise full authority over the conduct of their classes, including sequencing, pacing, pose selection, modification, and the permission or restriction of individual practices within the session. The Member shall comply with all safety directions of the instructor, including directions to modify, discontinue, or refrain from a particular pose, to use props, to reduce intensity, or, in aerial formats, directions concerning hammock height, wrap technique, and spotting. Attempting advanced poses, inversions, or aerial maneuvers without or against instructor direction constitutes a serious safety violation undertaken entirely at the Member's own risk, for which the Studio shall bear no liability, and which may attract suspension from the relevant program. An instructor's assessment of a Member's readiness for progression is conclusive within the class setting, and disagreement therewith shall be raised with Management outside class rather than contested during the session.
23. Personal Belongings & Valuables+
The Studio provides designated spaces for the keeping of footwear, bags, and personal effects during class as a convenience, and not as a bailment; the Studio does not accept custody of Members' belongings, and Members are strongly advised not to bring valuables, significant cash, or irreplaceable articles to the premises. Notwithstanding the CCTV surveillance maintained for general security, the Studio, its Management, instructors, and staff shall bear no liability for the loss, theft, misplacement, or damage of any personal belonging, howsoever occurring, save where such loss is directly attributable to the proven willful act of the Studio's own personnel. Articles found on the premises shall be held at the front desk for a period of thirty (30) days, whereafter unclaimed perishables may be disposed of and unclaimed articles of value dealt with as Management deems appropriate. Members shall not leave belongings at the Studio overnight without express front-desk permission.
24. Guests, Visitors & Accompanying Persons+
Access to the practice halls is restricted to enrolled Members of the relevant batch, instructors, and authorized staff. Guests and visitors accompanying a Member — including family members awaiting a practitioner, and parents or guardians accompanying children — shall remain in the reception area and shall not enter the practice halls during sessions, save with express front-desk permission granted for specific reasons such as assisting a senior or differently-abled Member. A parent or guardian of a child enrolled in kids batches may observe sessions in the manner and from the location designated by the Studio, without disrupting the class. Prospective members may observe a class only with prior Management approval, the free trial class being the designated avenue for first-hand experience. All visitors upon the premises are subject to the Studio's Code of Conduct, CCTV surveillance, and photography restrictions, and the Member introducing a visitor shall be responsible for the visitor's compliance therewith.
25. Prohibition of Intoxicants & Smoking+
The Studio premises are a smoke-free and intoxicant-free environment. The consumption, possession, or distribution of alcohol, tobacco products, e-cigarettes, or any narcotic or psychotropic substance upon the premises is absolutely prohibited, as is attendance at any class while under the influence of alcohol or any intoxicating or judgment-impairing substance. Given that yoga practice — and aerial practice in particular — demands unimpaired balance, coordination, and judgment, an instructor who reasonably apprehends that a Member is under the influence shall decline that Member's participation for the session, and such declination shall not give rise to any claim or entitlement. Repeated violation of this term shall constitute material breach warranting termination without refund. Members undergoing medical treatment involving sedative or balance-affecting medication shall disclose such treatment in the Health Declaration or to the instructor, so that practice may be appropriately moderated in the interest of the Member's own safety.
26. Unauthorized Commercial Activity & Solicitation+
The Studio premises and its community of members shall not be used by any Member for unauthorized commercial purposes. Prohibited activities include, without limitation: solicitation of members for competing yoga, fitness, or wellness services; marketing, sale, or promotion of products or services of any nature to members or staff; distribution of pamphlets or promotional material; recruitment of members for multi-level marketing schemes; and the conduct of private coaching within the premises otherwise than as an engaged instructor of the Studio. A Member who is themselves a yoga professional is welcome to practice at the Studio but shall not instruct, correct, or advise other members within the premises, instructional authority vesting exclusively in the Studio's engaged instructors. Violation of this term constitutes material breach entitling the Studio to terminate the membership without refund, and to recover damages where the Studio suffers demonstrable loss from such unauthorized activity.
27. Care of Studio Property & Equipment+
Members shall handle all Studio property — including mats, blocks, straps, bolsters, chairs, sound-healing instruments, aerial hammocks, rigging hardware, and the fixtures of both practice halls — with reasonable care, using each article only for its intended purpose and in the manner instructed. Defects, fraying, looseness, or damage noticed in any equipment, and in particular in any aerial hammock or rigging component, shall be reported to the instructor immediately and the equipment not used until cleared. Damage to Studio property caused by a Member's negligence, misuse, or violation of instructions shall be recoverable from the Member at the reasonable cost of repair or replacement, and may be set off against any refund or credit otherwise admissible. Members shall not adjust, re-rig, relocate, or tamper with aerial rigging, anchor points, or hall installations under any circumstances, such adjustments being reserved exclusively to authorized personnel following prescribed safety procedures.
28. Suspension & Termination for Breach+
Without prejudice to any other remedy, the Studio may suspend a Member's access to classes pending inquiry into any suspected material breach of these Terms, and may terminate the membership upon a breach being substantiated, in each case by written communication to the Member's registered contact details. Material breaches warranting termination include, without limitation: violation of the Code of Conduct; suppression or misdeclaration of health particulars; unauthorized photography or recording; sharing of membership access; attendance under the influence of intoxicants; willful damage to property; unauthorized commercial activity; abusive conduct toward staff or members; and defiance of safety directions during practice. Termination for the Member's breach shall result in forfeiture of fees in accordance with the Refund & Cancellation Policy, and the terminated individual may be declined future enrollment at the Studio's discretion. The Studio shall exercise these powers reasonably, proportionately, and after affording the Member an opportunity to be heard in all cases save those involving safety emergencies.
Part D Health, Safety & Risk
29. Voluntary Participation & Assumption of Inherent Risk+
The Member acknowledges that yoga, in all its forms taught at the Studio — including Hatha, Power, Ashtanga, Vinyasa, Kundalini, Chair, Prenatal, Kids, Senior, Therapeutic, and Aerial formats — is a physical discipline involving stretching, strength exertion, balance, breath regulation, and, in certain formats, elevation and inversion, and that such activity carries inherent risks that cannot be wholly eliminated even with competent instruction and reasonable care, including muscle strain, sprain, soreness, joint stress, dizziness, falls, and, in rare instances, more serious injury. Participation in every class, program, and event of the Studio is entirely voluntary, and the Member, having considered these inherent risks and their own physical condition, knowingly and freely assumes all such inherent risks of participation. This assumption of risk extends to practice at the Studio, home classes, online classes, outdoor sessions, and events, and shall bind the Member's heirs and representatives, without extinguishing rights conferred by law that are incapable of waiver.
30. Duty to Practice Within Personal Limits+
The Member bears a continuing personal duty to practice within the limits of their own body on each given day, to communicate discomfort candidly, and to exercise self-awareness as the first safeguard of safe practice. The Member shall immediately discontinue any pose or practice upon experiencing sharp pain, dizziness, breathlessness disproportionate to exertion, chest discomfort, numbness, or any sensation of impending injury, and shall inform the instructor forthwith. The Studio's teaching philosophy expressly disclaims competitive practice; the Member shall not measure their practice against other members nor push into ranges or holds beyond instructed progression. Modifications, props, and rest — including resting in a neutral pose at any point during class — are always available and carry no stigma within the Studio's culture. The Member acknowledges that an instructor cannot perceive internal sensations, and that the responsibility for truthful, immediate communication of distress rests with the Member alone, upon which communicated information the instructor will act with appropriate care.
31. Aerial Yoga — Enhanced Safety Obligations+
Participation in aerial yoga is subject to enhanced safety obligations, given the elevated and inverted nature of the practice. The Member shall: attend only batches for which they are enrolled and assessed; follow the instructor's directions on hammock height, fabric wraps, entry, exit, and spotting without deviation; attempt inversions and advanced maneuvers only upon the instructor's explicit clearance; refrain from swinging, dropping, or improvising maneuvers not taught in the session; disclose immediately any dizziness, nausea, or disorientation; and refrain from aerial practice when affected by conditions contraindicating inversion, including uncontrolled blood pressure, glaucoma, vertigo, recent surgery, hernia, severe osteoporosis, and pregnancy. The Studio maintains professionally installed, load-tested rigging inspected on a defined schedule, mats beneath every hammock, and deliberately limited batch sizes; these institutional safeguards operate in conjunction with, and not in substitution of, the Member's own compliance, which the Member acknowledges to be indispensable to safe aerial practice.
32. Pregnancy, Postnatal Recovery & Practice Modification+
A Member who is pregnant, or who has reason to believe she may be pregnant, shall disclose such status to the Studio at the earliest, whereupon her practice shall be transitioned to the Studio's certified prenatal program, conducted with trimester-appropriate asanas, labour-preparation pranayama, and relaxation practices, at the studio or as home sessions. General batches, dynamic formats, deep twists, closed inversions, and aerial practice are not appropriate during pregnancy, and continued participation therein after disclosure — or non-disclosure of pregnancy — shall be entirely at the Member's own risk, the Studio's prenatal safeguards being dependent upon disclosure. Enrollment in the prenatal program is subject to the treating physician's clearance, which the Studio may require in writing. Postnatal return to practice shall commence with the Studio's postnatal program at the time cleared by the Member's physician, ordinarily not earlier than six weeks after delivery, with graduated progression back toward general and aerial formats under instructor assessment.
33. Medical Emergencies & First Response+
In the event of a medical emergency upon the premises, the Studio's personnel shall render such reasonable first response as the situation permits — including first aid, summoning of emergency medical services, and intimation of the Member's nominated emergency contact — and the Member hereby consents to the administration of such reasonable emergency assistance and to the sharing of relevant health information with medical responders as contemplated by the Studio's Privacy Policy. The Member acknowledges that the Studio is a yoga facility and not a medical establishment, that its personnel are not medical professionals, and that first response does not constitute medical treatment. All costs of ambulance, hospitalization, and medical treatment shall be borne by the Member. Every Member shall keep their nominated emergency contact current in the Studio's records. An incident report shall be prepared for every significant medical event, and the Member or their representative shall cooperate in its accurate completion, such reports being maintained for safety review and lawful purposes.
34. Communicable Illness & Community Health+
In the interest of the health of the practicing community across both halls, a Member suffering from a communicable illness — including influenza-like illness, conjunctivitis, contagious skin conditions, or any condition notified by health authorities as requiring isolation — shall refrain from attending classes for the duration of contagion, and the freeze provisions of the Refund & Cancellation Policy shall be available for qualifying absences. The Studio may, acting reasonably and with discretion, request a visibly unwell Member to defer practice for the day, and such request shall not give rise to any claim. The Studio undertakes on its part to maintain the hygiene standards described in its published materials, including daily sanitization of mats, props, and hammocks, ventilation of the practice halls, and cleanliness of bathrooms and changing areas. During any epidemic or public-health directive, the Studio shall implement such protocols — including masking, distancing, capacity limitation, or temporary closure — as law or prudent practice requires, in accordance with the force majeure provisions of the Refund & Cancellation Policy.
35. Yoga Instruction Is Not Medical Advice+
The instruction, therapy protocols, dietary suggestions, and lifestyle guidance offered by the Studio — including within yoga therapy, weight management, and lifestyle-disease programs addressing conditions such as back pain, diabetes, hypertension, thyroid imbalance, and PCOD — constitute yogic and wellness guidance grounded in classical practice and the Studio's institutional experience, and do not constitute medical advice, diagnosis, or treatment, nor a substitute therefor. The Member shall continue under the care of their treating physicians, shall not discontinue, commence, or modify any medication or medical treatment on the basis of yogic guidance without their physician's concurrence, and shall obtain medical clearance where these Terms or the Studio so require, including for cardiac-safe programs and post-surgical return to practice. Where guidance of the Studio appears to conflict with medical advice received by the Member, the medical advice shall prevail and the conflict shall be disclosed to the Studio so that the Member's practice may be appropriately adapted.
36. Insurance & Personal Coverage+
Fees paid to the Studio are consideration for instruction and facility access alone and do not include any personal accident, medical, or life insurance coverage for the Member. The Member is advised, and solely responsible, to maintain such personal health and accident insurance as they consider prudent for participation in physical activity, and to verify that their existing policies do not exclude activities of the nature undertaken, including aerial practice. Any insurance maintained by the Studio in respect of its premises, equipment, or operations enures to the benefit of the Studio alone and confers no direct entitlement upon Members. In the event of an incident potentially involving an insurance claim by either party, the Member shall cooperate reasonably in the documentation of the incident, including the incident report contemplated by these Terms, and the Studio shall likewise extend reasonable cooperation, including such disclosure of CCTV footage to insurers as is contemplated by the Studio's Privacy Policy.
37. Children & Minors — Guardian Responsibilities+
Enrollment of every individual below eighteen (18) years shall be made by a parent or legal guardian, who shall execute all forms, grant or decline all consents, and stand bound by these Terms on the minor's behalf, warranting their authority to do so. The guardian shall ensure the minor's punctual drop-off and collection at the scheduled batch timings, the Studio's supervisory responsibility being confined to the duration of the enrolled session within the premises; the Studio shall not be responsible for minors before drop-off into, or after release from, the session. The guardian shall disclose all health conditions of the minor with the candour these Terms require of adult Members, shall keep emergency contacts current, and shall instill in the minor compliance with instructor directions. The Studio's protections concerning minors' photographs, personal information, and CCTV coverage are set out in its Privacy Policy, which the guardian confirms having reviewed. Guardians shall be liable for damage to Studio property caused by their wards.
38. Outdoor Sessions, Events & Off-Premises Activities+
The Studio periodically conducts activities beyond its premises — including International Yoga Day gatherings, park sessions, society and community camps, corporate on-site sessions, workshops at external venues, and retreats — participation in which is voluntary and subject to these Terms together with any activity-specific conditions communicated at registration. The Member acknowledges that off-premises venues are not under the Studio's control, that conditions of terrain, weather, and third-party facilities introduce variables absent from studio practice, and that the assumption of inherent risk under these Terms extends fully to such activities. Travel to and from off-premises activities is undertaken at the Member's own arrangement and risk unless transport is expressly provided by the Studio. The Studio may cancel, curtail, or relocate an outdoor activity on account of weather, safety, or permissions, in which case the remedies, if any, shall be those communicated for the specific activity, ordinarily comprising rescheduling or credit rather than refund.
Part E Programs, Courses & Digital Services
39. Teacher Training & Certification Courses+
Enrollment in the Studio's Teacher Training and certification programs — including Yoga TTC, Aerial TTC, Sound Healing, Meditation, and Yoga Nidra facilitator courses — is additionally governed by the curriculum, attendance, assessment, and completion requirements of the respective course, communicated at admission. Certification is conferred solely upon fulfilment of all academic requirements, including prescribed attendance thresholds, assignments, and practical assessments, together with full payment of course fees, and the withholding of certification for non-fulfilment shall not constitute deficiency of service. Course seats are limited; deferrals, refunds, and material charges are governed by the Refund & Cancellation Policy. Trainees shall observe the professional standards of the Studio during practicum, including its safety protocols and conduct requirements toward members. Certification attests to completion of the Studio's program and does not, of itself, constitute a governmental licence; trainees intending professional practice shall satisfy themselves as to any registrations required in their jurisdiction of practice. Alumni benefits, mentorship, and teaching opportunities across the SKM network are discretionary and subject to availability and merit.
40. Workshops, Special Sessions & Guest Faculty+
Workshops, masterclasses, sound baths, aerial photoshoot sessions, and special events are standalone offerings governed by the specific terms announced for each — including eligibility, prerequisites, capacity, and pricing — read together with these Terms. Registration is confirmed only upon payment, seats being allocated in order of confirmed registration. The Studio may engage guest faculty for particular workshops; the identity of announced faculty is provided in good faith, and the Studio reserves the right to substitute faculty of comparable standing where circumstances so require, such substitution not constituting grounds for refund where the workshop proceeds substantially as described. Workshop content, sequences, and materials are provided for the registrant's personal practice and learning, and shall not be reproduced, taught commercially, or distributed without written permission. Transfers of workshop registration to another named individual, and remedies upon cancellation by the Studio, are governed by the Refund & Cancellation Policy. Conduct requirements and photography rules under these Terms apply fully to all workshops and events.
41. Home Classes — Additional Conditions+
Home classes within the Sector 30–51 service belt are subject to the following additional conditions. The Member shall provide a safe, clean, adequately ventilated practice space, reasonably free of obstruction, and shall secure pets during sessions. The instructor attends solely to conduct the scheduled session and shall not be asked to render unrelated services; courteous conduct of the household toward the visiting instructor is a condition of the service, and substantiated discourtesy or impropriety toward an instructor shall entitle the Studio to withdraw home service to that household without refund of unutilized sessions beyond what the Refund & Cancellation Policy admits. Scheduling, rescheduling, and forfeiture of home sessions are governed by the said Policy, including its six-hour notice requirement. Home aerial practice is not offered, professional rigging being incapable of assurance in domestic settings, and requests therefor shall be declined in the interest of safety. The Studio's instructors carry identification, and households may verify credentials at 8920921620 before admitting any person claiming to be a Studio instructor.
42. Online Classes — Additional Conditions+
Live online classes are offered over third-party video platforms whose own terms additionally apply, as detailed in the Studio's Privacy Policy. The Member participating online shall arrange a stable internet connection, a device with adequate audio-visual capability, and a safe, obstruction-free practice space with a stable, non-slip surface; the Member acknowledges that online instruction is delivered without physical presence, that the instructor's capacity to observe and correct is limited by camera framing and connectivity, and that the duty of self-aware practice within personal limits applies with added force in the online setting. Interruptions attributable to the Member's connectivity shall not entitle the Member to session credit; interruptions attributable to the Studio's connectivity exceeding half the session shall entitle affected participants to a make-up session. Recording of online classes by Members is prohibited without written approval, and class links are personal to the enrolled Member and shall not be shared. Online participation is not recommended, and may be declined, for aerial formats and for first-time therapy assessments requiring physical evaluation.
43. Corporate & Society Programs+
Corporate wellness programs and residential-society batches are contracted with the sponsoring organization, RWA, or committee (the "Sponsor") under a proposal or agreement specifying sessions, venue, schedule, and commercials, read together with these Terms. The Sponsor shall provide a safe and suitable venue — clubhouse, hall, or office space — with reasonable cleanliness, ventilation, and space per participant, and shall communicate the Studio's health-disclosure requirement to all participants, each of whom participates subject to the assumption-of-risk and conduct provisions of these Terms notwithstanding that payment flows from the Sponsor. Participant lists, where maintained, shall be handled in accordance with the Studio's Privacy Policy. Rescheduling of sponsored sessions requires the notice period stated in the proposal; sessions frustrated by venue unavailability attributable to the Sponsor shall stand consumed. Invoicing, credit terms, and taxation shall be as per the proposal, and the Sponsor shall not represent the Studio's services under any name other than SKM Yoga without written permission.
44. Yoga NET/JRF & Academic Coaching Programs+
The Studio's UGC NET/JRF Yoga preparation and allied academic coaching programs provide structured instruction across the prescribed syllabus — Yoga Philosophy, History, Yogic Texts, Anatomy and Physiology, Research Methodology, and examination practice — with mentorship under Dr. Shivam Mishra, at the studio and online. Enrollment confers access to the announced schedule of lectures, materials, and test series for the enrolled batch. Study materials, question banks, and recorded resources, where provided, are licensed for the enrolled candidate's personal preparation alone and shall not be reproduced, circulated, resold, or uploaded to any platform, such acts constituting infringement of the Studio's intellectual property attracting termination and legal remedy. The Member acknowledges that examination success depends upon the candidate's own preparation, aptitude, and performance, and that no assurance of qualification, rank, or fellowship is made or implied; illustrative results of past candidates are historical facts, not predictions. Course deferrals and refunds are governed by the certification-course provisions of the Refund & Cancellation Policy.
Part F Liability, Intellectual Property & Legal Provisions
45. Limitation of Liability+
To the maximum extent permitted by applicable law, the aggregate liability of the Studio, its proprietors, Management, instructors, and staff, arising out of or in connection with these Terms or the services — whether in contract, tort, or otherwise — shall not exceed the total fees actually paid by the concerned Member to the Studio during the twelve (12) months preceding the event giving rise to the claim, and the Studio shall in no event be liable for indirect, incidental, consequential, or remote losses, including loss of earnings or opportunity. Nothing in these Terms excludes or limits liability for death or personal injury caused by the Studio's own proven negligence, for fraud, or for any liability incapable of exclusion under law, including the non-waivable protections of the Consumer Protection Act, 2019. The Studio shall not be liable for the acts of persons outside its control, including other members, visitors, and third-party service providers, save to the extent the law attaches such liability notwithstanding this term. This clause survives termination or expiry of the membership.
46. Indemnity by the Member+
The Member shall indemnify and hold harmless the Studio, its proprietors, Management, instructors, and staff from and against all claims, demands, losses, damages, costs, and expenses, including reasonable legal costs, arising out of or attributable to: (a) the Member's breach of these Terms, the Refund & Cancellation Policy, or the Privacy Policy; (b) suppression, misdeclaration, or non-updation of health particulars upon which the Studio's safety protocols depend; (c) injury or loss caused by the Member to any other member, visitor, instructor, or staff, or to the property of any of them or of the Studio; (d) the Member's violation of safety directions, including unauthorized aerial maneuvers and tampering with rigging; (e) unauthorized recording or publication of imagery of other individuals at the premises; and (f) claims of third parties arising from content published by the Member on their own platforms concerning the Studio or persons encountered there. This indemnity is in addition to, and not in derogation of, the Studio's other rights, and survives termination of the membership.
47. Intellectual Property of the Studio+
All intellectual property of the Studio — including the SKM Yoga name and marks, the Studio's logos and brand identity, its class sequences and program structures, course curricula, training manuals, study materials, question banks, recorded content, website content, and promotional media — is and shall remain the exclusive property of the Studio or its licensors. The Member is granted no licence therein save the limited right to use provided materials for personal practice and learning during the relevant enrollment. The Member shall not reproduce, distribute, publish, teach commercially, or create derivative works from the Studio's materials, nor use the SKM Yoga name or marks in any trade name, handle, domain, or promotional material, nor represent any affiliation with or endorsement by the Studio, without prior written permission of Management. Certified alumni may describe their certification factually in professional profiles. Infringement of this term entitles the Studio to terminate the membership or course enrollment without refund and to pursue injunctive and monetary remedies as available in law.
48. Privacy, CCTV & Media — Incorporation of Privacy Policy+
The collection, use, storage, disclosure, and protection of the Member's personal information — including enrollment particulars, health declarations, payment records, photographs and videos captured during classes and events, promotional use of member imagery, testimonials, minors' protections, communications and opt-outs, CCTV surveillance of the premises, retention schedules, and the Member's rights of access, correction, deletion, and takedown — are governed exhaustively by the Studio's Privacy Policy, displayed at the premises and on skmyoga.in, which stands incorporated into these Terms by reference as though set out herein in full. The Member confirms having had the opportunity to review the said Policy prior to enrollment, and acknowledges in particular that the premises are under continuous CCTV surveillance (excluding bathrooms and changing areas) and that photographs and videos captured during classes and events may, subject to the consents and safeguards described therein, be used for the Studio's promotional purposes. In the event of inconsistency between these Terms and the Privacy Policy on matters of personal information, the Privacy Policy shall prevail.
49. Force Majeure, Severability, Waiver & Entire Agreement+
The consequences of events beyond the reasonable control of either party — including epidemic, governmental order, natural calamity, fire, and civil unrest — upon the Studio's services and the Members' memberships are governed by the force majeure provisions of the Refund & Cancellation Policy, incorporated herein by reference. If any term herein is held invalid or unenforceable by a competent authority, the remaining terms shall continue in full force, and the offending term shall be read down to the minimum extent necessary to render it valid. No forbearance, indulgence, or delay by the Studio in enforcing any term shall constitute a waiver thereof or of any other term, and a waiver on one occasion shall not operate as a waiver on any subsequent occasion. These Terms, together with the Refund & Cancellation Policy, the Privacy Policy, the enrollment documentation, and any written program-specific conditions, constitute the entire agreement between the Member and the Studio, superseding all prior brochures, representations, advertisements, and verbal assurances on the subjects covered.
50. Governing Law, Grievances & Exclusive Jurisdiction+
These Terms shall be governed by and construed in accordance with the laws of India. Prior to initiating any legal proceeding, the parties shall attempt good-faith resolution of every grievance through the Studio's escalation mechanism — the front desk at F-18, Sector 39, Noida, WhatsApp at 8826476724, calling at 8920921620, or email at admin@skmyoga.in — for a period of fifteen (15) days from written intimation, the Studio undertaking to acknowledge grievances within seventy-two (72) hours and to respond substantively within fifteen (15) working days. Subject thereto, all disputes arising out of or in connection with these Terms or the services shall be subject to the exclusive jurisdiction of the competent courts and consumer fora at Gautam Buddha Nagar, Uttar Pradesh. Nothing herein excludes, restricts, or overrides any non-waivable right of the Member under the Consumer Protection Act, 2019, or other applicable law. Payment of any fee to the Studio shall constitute conclusive acknowledgment that the Member has read, understood, and accepted these fifty Terms in their entirety.
